By entering into a verbal agreement with Two Casitas Santa Fe Vacation Rentals,LLC are agreeing to the written terms and conditions listed below. Please read and review the Terms & Conditions carefully. If you have any questions or concerns please let us know.
This is an Agreement between you, the TENANT, and the Owner of the PROPERTY .The Agreement between Two Casitas, Santa Fe Vacation Rentals, LLC.( here in referred to Two Casitas) who is the agent of the Owner. You the TENANT have asked that Two Casitas reserve the PROPERTY for your use during the TERM OF OCCUPANCY. Two Casitas is presently reserving the PROPERTY for you subject to the following terms and conditions:

- The RENT DEPOSIT is due within ten days of your booking, otherwise we may not hold the Property for you.
Making a reservation
We must have at least one telephone conversation with you to book a house. We have on line booking under the reservation tab labeled “book now” Here you can fill out all your information and give us your Credit card # in a secure form. However, your reservation is not confirmed until we reach you or you reach us on the phone. I like to talk to my guests at least once before confirmation to make sure we are on the same page, to meet you and to answer any questions you may have.
A 50% deposit is required to reserve a home at the time of booking, with the balance due on arrival. Our preferred method of payment is a personal check of 50% of your total rental cost.

Prices and additional Fees
Low Season rates - Nov. 1 ~ April 30
High Season rates - May 1 ~ Oct. 31
High season rates includes all holidays and special local events.
Additional to your nightly rate 2.456% % tax (Gross receipts)
Additional to your nightly rate 7.0% tax (City of Santa Fe lodgers tax for legal and permitted houses) No lodgers tax will be charged on houses that are commercially zoned. These properties are Rosario, Mckenzie Suite and Mckenzie Studio
Confirmation and check in
After recieving your 50% deposit or charge your credit card Two Casitas will email you a confirmation explaining the self check in procedures, with directions to your house, how much you have paid and how much is owed. Where to get your key and how to pay your balance due.
Check-in time: 3 pm and on
Check-out time: 11 am
The BALANCE DUE for the Property shall be due and payable to Two Casitas no later than the date of departure.
Limitation on Occupants
TENANT shall not allow more than the MAXIMUM NUMBER OF OCCUPANTS to occupy the PROPERTY overnight.
The following supplies and amenities are provided upon your arrival (if you should need additional supplies please plan to bring with you or purchase in Santa Fe as needed) 4 rolls of toilet paper per bathroom 1 roll of paper towels 1 kitchen sponge , 1 dish washing soap 1 dish washer soap 1 small roll of trash bags 1 box of Kleenex .
If TENANT cancels TENANT"S occupancy more than 60 days before the commencement of the TERM OF OCCUPANCY, TENANT's Rent Deposit will be refunded, less a handling fee in an amount of $60.00 if paid by check or 12% of the total fee charge to your credit card. If TENANT cancels TENANT"S occupancy 60 or fewer days before the commencement of the TERM OF OCCUPANCY, TENANT will receive a refund only if Two Casitas is able to find a substitute occupant for the TERM OF THE OCCUPANCY who will pay the same rent. If a substitute occupant is found, all sums paid by TENANT shall be refunded to TENANT, less 20% of the RENT. If a substitute occupant is not found, there will be no refund of any sums paid by TENANT.
Condition of Property
TENANT shall receive the property in reasonable and clean condition and TENANT shall reasonably maintain the PROPERTY. TENANT shall be liable for any loss or breakage of the contents of the PROPERTY. If there is any breakage, damage or theft to the PROPERTY or the furnishings and appliances within the PROPERTY, TENANT shall notify Two Casitas; as soon as possible and TENANT shall provide TWo Casitas with a reasonable opportunity to repair any such condition.
If any damaged is caused by the TENENT they are expected to pay for this damage and tell Two Casitas of damage right away.Nothing shall be taken from your rental home.
DAMAGE AND PET DEPOSIT:
A Credit Card on file or Security Deposit Insurance must be agreed upon, prior to arrival, as a security deposit to cover all damages incurred such as breakage or damage to the appliances, furnishings, or the property itself. The open credit card is also for the purpose of Covering any damage as a result of the occupancy of a pet.
Initial Cleaning and Additional Cleaning.
Cleaning fees for a studio are 75.00 One bedroom 100.00 Two Bedroom 150.00 Three bedroom 200.00 The TOTAL DUE includes a CLEANING FEE, which shall be applied to cleaning the PROPERTY at the end of the term. If the TERM OF OCCUPANCY exceeds 4 weeks, TENANT shall allow the PROPERTY to be cleaned every two weeks at the TENNETS expense by the hour by Two Casitas cleaning staff.
In the event Pets are allowed on the leased premises, TENANT agrees to pay an additional non-refundable Pet Fee at the time of $100 per pet, and TENANT further agrees to pay for any additional cleaning or damages of the property at the end of the lease term at TENANTs expense. Two Casitas reserves the right to charge this Pet Fee for pets that are not disclosed prior to tenancy.
Remote Control and Key Return Policy
A $25.00 charge will be incurred in the event TENANT loses or misplaces a key. In the event any remote control is lost, tenant shall pay for the cost of replacement of the remote control device. All keys, gate remote controls, and garage openers shall be left in the house on the kitchen counter at the termination of the lease term.
TENANT'S Conduct on Property
No smoking is allowed in the PROPERTY. TENANT agrees to assume all legal responsibility for the acts and conduct of any of TENANT's guests and to assure compliance with all house rules. Smoking is allowed outside, on porches only. A violation of the no smoking policy will result in a $250 mandatory cleaning fee.
Right of Entry
The Owner or the Owner;s agent, Two Casitas , or an agent designated by either of them, may enter the PROPERTY at any reasonable time to inspect, repair, maintain or show the PROPERTY with notice to the TENANT.
Risk of Loss to Property
Neither Owner's nor Two Casitas's insurance cover loss or damage to TENANT's personal possessions and TENANT shall bear the risk of loss of all TENANT's property. The PROPERTY is not protected by an alarm system. (If an alarm system is installed at the PROPERTY, it will not be operable during your occupancy of the PROPERTY).Twpo Casitas and the Owner shall have no duty regarding security of the PROPERTY
Indemnification and Hold Harmless
Neither Two Casitas nor Owner shall be liable for any injury or damage to persons or property arising from act or omission of TENANT, TENANT'S family, TENANT,S guests, TENANT'S invitees or visitors. Neither Two Casitas nor Owner will be liable for losses or damages to TENANT'S property by theft, vandalism, fire, smoke, water, rain, hail, ice, snow, explosion, acts of God, acts of other residents, or any other causes other than as a direct and proximate result of the gross negligence of Agent or Owner. TENANT will hold harmless Two Casitas, Inc. and Owner, and their employees and agents, from any liability due to loss or damage to the property of TENANT or others present on the PROPERTY from any cause other than gross negligence or the intentional acts of Two Casitas Owner or their employees and agents.
The property that you lease may or may not have air conditioning. Please refer to our Website for property amenities and confirm with your leasing agent.
Two Casitas. will make all reasonable efforts to insure that all mechanical systems are working property, including malfunctions and repairs. TENANT agrees to notify Two CasitasI of any defect in any mechanical system. Two Casitas is not liable to TENANT for any mechanical malfunction and TENANT is not entitled to reimbursement for any rent.
No chemicals lotions or other substances will be put in hot tub.fTENANT or others present on the PROPERTY that use or are around the hot tub will not hold liable Two Casitas or the Owner or their employees and agents for any harm at all when using the tub.
TENANT shall be liable for attorney's fees and expenses incurred by the Owner or Two Casitas. (and their agents and employees) should TENANT breach this agreement or in the event TENANT does not prevail in any claim brought by TENANT against Owner and/or Two Casitas. The law of the State of New Mexico shall govern any and all disputes between the parties to this Agreement. Venue for any legal action between the parties shall be Santa Fe County, New Mexico.
