Rental Agreement between Two Casitas, Santa Fe Vacation Rentals and Guest

To secure a reservation with Two Casitas, Santa Fe Vacation Rentals (herein referred to as TCSFVR), Guests must accept and agree to the Terms and Conditions that follow:

  1. Guest agrees to pay all rent and fees requested by TCSFVR upon making a reservation. Failure to do so will result in denial of access to the home.
  2. Parking
    1. Parking availability varies from rental to rental.
    2. Vehicles are to be parked in designated parking areas only.
    3. Any illegally parked cars are subject to towing or fines. Towing fees or fines are the sole responsibility of the vehicle owner.
    4. No trailers, vans, or recreational vehicles (RV’s) are permitted without prior permission from the homeowner and TCSFVR.
  3. Fireplaces and fire pits
    1. Fireplaces and fire pits are not available for use from May 15th – October 1st, and flues must remain closed during this time.
    2. Guest is responsible for all damages caused by smoke or fire.
    3. Guest must not throw any paper or other combustible materials in the fireplace or fire pit.
    4. Guest must not leave children or pets unattended near the fireplace or fire pit.
    5. Guest must not leave fire unattended.
    6. Screens must be on while a fire is burning.
    7. Guest must take caution when building a fire.
    8. If Guest chooses to clean the fireplace or fire pit, all ash from the fireplace must be placed in the provided covered container.
    9. Gas fireplaces must be turned off, and wood burning fires must be extinguished before going to bed.
    10. Follow all posted instructions regarding the fireplaces in each home.
  4. Water/Plumbing
    1. All properties have either city water or well water. The mineral content in the tap water is high. The water may have an odor and taste that you are not accustomed to. If that is the case, we recommend that you purchase bottled water at a grocery store. TCSFVR will not reimburse any money or make any stay modifications due to the taste or smell of the water.
    2. DO NOT FLUSH anything (including feminine products) other than toilet paper and human waste. Failure to follow this rule will result in the Guest being charged for damages up to and including professional plumbing services and the cost of upcoming reservations should the property not be ready for future Guests.
  5. Hot Tubs (If applicable)
    1. The Guest has permission to use the hot tub between the hours of 8am and 10pm. Guests must be considerate to neighbors when it comes to noise.
    2. If TCSFVR receives a complaint about excessive noise, or the hours of hot tub use are violated, your hot tub privileges will be revoked.
    3. Hot tubs have a maximum capacity of six people.
    4. Guest must not use the hot tub if you are pregnant or on any medication without consulting a doctor beforehand.
    5. Guest must not adjust the temperature of the hot tub. It is set between 101 – 104 degrees Fahrenheit. Changing of the temperature without the express permission of a TCSFVR employee or contractor will result in a $100 re-heating fee.
    6. Guest must not disconnect the hot tub from power. TCSFVR will charge a $100 re- heating fee if this occurs, and the hot tub will need 24 hours to return to a normal temperature.
    7. Guest will never leave children unsupervised while using the hot tub.
    8. Guest must always replace the cover over the hot tub when not in use. Failure to do so will result in dirt/debris entering the hot tub along with a decline in water temperature.
    9. Guests are not to take glasses into or near the hot tub.
    10. TCSFVR advises that no alcohol be consumed while using the hot tub.
    11. The water in each hot tub is fully inspected and maintained between all reservations. Should any of the following occur during a Guest’s stay, there will be a $100 fee charged to the card on file.
      1. Water becomes cloudy or opaque.
      2. Use of makeup or cosmetics while in the hot tub.
      3. Use of sun tan cream or oils.
      4. Dirty feet entering the hot tub (Guest must use sandals or other protective footwear when walking outside and approaching the hot tub).
      5. Spillage of drinks or other liquid in the water.
  6. Pool (if applicable)
    1. The Guest(s) will use the pool at the Guest’s own risk. The landlord will not be held responsible for any injuries sustained by the Guest and/or the Guest’s occupants or Guests when using the Pool and corresponding equipment, and the Guest will indemnify the landlord for any actions resulting from injuries to Guest and/or occupants or Guests.
    2. Children must be supervised when using the pool, or when within 20ft of the pool.
    3. The Guest understands and agrees to allow TCSFVR and their agents access at regular times to maintain the Pool and corresponding equipment. The Guest agrees to refrain from attempting to make any repairs or adjustments to the Pool and corresponding equipment or to any of the electrical wiring for the Pool and corresponding equipment.
    4. The Guest must immediately notify the Property Manager of any repair that the Pool and corresponding equipment may require. The Guest is responsible for the full cost that may be due for repair and/or replacement of the Pool and corresponding equipment that is required due to negligence by the Guest. The Guest must operate the Pool and corresponding equipment in accordance with the manufacturer’s instructions and in a safe, responsible manner.
    5. No pets of any kind are permitted in the swimming pool/spa at any time.
    6. The Guest understands that the Pool and corresponding equipment are strictly an amenity and that the use of these amenities is not guaranteed under the terms of the lease. Any interruption or non-availability of the use of the Pool and corresponding equipment will not violate any terms of the lease.
    7. Any violation of the terms in this agreement will be considered a material breach of the lease. in the event of a default, the landlord may initiate legal proceedings in accordance with local and state regulations to evict or have the Guest removed from the leased premises, as well as seek judgment against the Guest for any monies owed to TCSFVR or the Homeowner due to the Guest’s default.
    8. Guest understands that outdoor pools will not be available for use during the winter months. We shut the pool down in early October to mid-May each year to prevent freezing.
  7. Check-in/Check-out
    1. Check-in time is 4pm.
    2. Check-out time is 10am.
    3. Late check-outs are not allowed. Guest must vacate the premises by 10am on the agreed upon date in their reservation confirmation.
    4. Early check-ins are allowed on a case-by-case basis for a $100 fee. Early check-ins must be arranged and approved by TCSFVR.
  8. Housekeeping
    1. The rental will be professionally cleaned before the Guest arrives.
    2. Two Casitas reserves the right to charge a cleaning fee.
    3. Cleaning fees are doubled for stays longer than 28 nights.
    4. There is no daily housekeeping service offered.
    5. Linens and bath towels are included with the rental.
    6. Towels and linens may not be removed from the rental.
    7. Additional cleaning services can be arranged at Guest’s expense subject to availability.
  9. Guest must request and get approval for any events, parties, and gatherings to be hosted at the rental before the booking is made. Event fees may apply.
  10. TVs
    1. All pay-per-view or other media purchases are the Guest’s financial responsibility.
    2. Guest acknowledges that they have read and understood the type of entertainment system(s) that their rental has.
    3. Guest must log out of all personal streaming accounts before leaving.
  11. Air-Conditioning
    1. Guest acknowledges that they have read and understand the kind of air-conditioning that their rental has or does not have. Not all properties have air-conditioning.
    2. Swamp/evaporative coolers are not available during the winter months. Air- conditioning is only guaranteed from June 1st – September 30th.
  12. Pet Policy
    1. Only dogs are permitted at pet-friendly homes. All other animals are not allowed.
    2. TCSVR has the right to charge a pet fee. The amount will be specified in Guest’s quote or invoice provided by TCSFVR or the third-party listing site through which the Guest books (if applicable).
    3. Additional dogs must be approved by TCSFVR, and may incur additional fees.
    4. Guest must disclose all dogs to TCSFVR. Failure to disclose dogs will result in a $1,000 fine charged to the credit card on file.
    5. Dogs are not allowed in homes that are not pet-friendly.
    6. Only hypo-allergenic dogs are allowed in homes that have that specific restriction.
    7. Guests will pay a $100 fine for not picking up their dog’s waste.
    8. Animals are not allowed on furniture at any time. Evidence of animals on furniture (pet hair, bodily fluids from pets, or damage to the furniture itself) may result in additional cleaning fees, or reimbursement for the cost of replacing or repairing the furniture.
    9. If an animal damages the property or the landscaping, the Guest is fully responsible for any damage, as animal damage is not covered by the accidental damage waiver. Any damages must be reported to TCSFVR immediately.
    10. Guest must prevent pets from producing excessive noise at a level that disturbs neighbors. If, after we have contacted you that a complaint has been received, excessive noise persists, we reserve the right to cancel the reservation and ask the Guest to vacate the premises. Alternatively, the dog can be boarded at the Guest’s expense. No refunds shall be given should this occur.
    11. TCSFVR and homeowner assume no responsibility for illness or injury that may incur to pets or humans while on the premises.
    12. It is the sole responsibility of the Guest to comply with all New Mexico, County of Santa Fe and City of Santa Fe laws and ordinances as related to dogs.
    13. Guests are solely responsible for their pet(s) while on the property.
    14. Pets are not allowed for stays longer than 14 days unless approved by TCSFVR.
    15. Pets may require additional cleaning services for long-term stays.
  13. An Accidental Damage Waiver/Insurance is included with every reservation, unless otherwise specified in the listing description (see section 14).
    1. This waiver is a one-time, non-refundable fee that covers up to $1000 worth of repairs or replacements should any damage occur in the rental during a reservation.
    2. Guest must contact TCSFVR directly if you do not wish to participate in this plan. If Guest opts out, all damages to the home will be charged to the card on file.
    3. Exclusions and exceptions for Accidental Damage Protection Insurance coverage include the following (Guests are directly and financially responsible for damages that fall under these exceptions):
      1. Damage not reported to management prior to departure.
      2. Smoking in, or within 15 feet of, the house. If smoke is detected there will be a fine of $1,000.
      3. Missing key(s) not returned to the lock box where applicable.
      4. Lost or stolen linens
      5. Theft
      6. Costs associated with returning items left in rentals prior to Guest’s departure.
      7. Pet damage in the home or around the grounds
      8. Gross negligence
      9. Misuse of appliances (anything other than their intended uses)
      10. Misuse of plumbing
      11. Misuse of fireplaces; including smoke damages from improperly built fires or use of fireplace while flue is closed by TCSFVR.
  14. Cancellation Policy:
    1. Guests have 24hrs from the moment of booking to cancel their reservations with a full refund.
    2. After the first 24hrs, reservations cancelled more than 14 days from the check-in date will incur a cancellation fee equal to 10% of the total reservation.
    3. After the first 24hrs, Reservations cancelled within 14 days of check-in are not eligible for a refund.
    4. Reservations made on third-party online travel agencies are subject to the cancellation policies that are advertised on that channel.
    5. If Guest is not eligible for a refund, and is able to provide documented proof (approved by a TCSFVR manager) of their inability to travel, TCSFVR can save Guest’s deposit for a future stay. The credit is to be stored as a dollar value, and can only be applied to the same property within one year of the original reservation’s check-out date.
  15. Any Guest who stays longer than 28 days is considered a long-term Guest.
    1. Long-term Guests are responsible for supplying their own toiletries, cleaning supplies, laundry supplies, and all other supplies needed for their stay beyond what TCSFVR provides for a standard-length booking.
    2. Long-term Guests will pay a cleaning fee that is double the standard cost. Additional cleanings will be standard rate at the Guest’s expense.
    3. All mid-stay cleans require at least one week’s notice.
  16. If TCSFVR provides written notice 24hrs in advance, Guest must allow TCSFVR and third-party contractors access to the property for the purposes of repair and inspection. TCSFVR shall exercise this right of access in a reasonable manner. Should an emergency arise, TCSFVR and third-party contractors may enter the property without notice.
  17. Smoking is not allowed inside of the rentals. Smoking is allowed outside, but Guest must be fifteen feet away from any door or window. Guest must not smoke within 20 feet of any adjoining rental and its occupants if applicable. Violations of smoking rules will result in a $1,000 fee.
  18. All units are privately owned. The homeowners and TCSFVR are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities.
  19. The homeowners and TCSFVR are not responsible for any loss of personal belongings or valuables.
  20. TCSFVR is not responsible for any packages sent to the property.
  21. Guest must keep the property and all furnishings in good order. The Guest must not rearrange the furniture.
  22. Illegal Activities: All authorized persons (those named on the lease agreement), and their Guests shall abide by all municipal, county, state and federal laws. No weapons or illegal drugs are allowed at any property owned/managed by TCSFVR. Lessee agrees to allow TCSFVR full access to the property if an illegal activity is suspected. Lessee and his/her Guests agree to immediately cooperate with law enforcement and emergency personnel. Any involvement in illegal activity by the Guest and his/her party or Guests will result in immediate eviction and forfeiture of all money owed to TCSFVR.
  23. Guests must be respectful of local noise ordinances, and must be considerate towards neighbors at all times.
  24. Lost Keys: In the event Guest, any member of his/her approved party, or their Guest loses a key, TCSFVR reserves the right to charge a $30 key replacement charge. In the event that the key loss leads to having to change door knob(s) and/or dead bolts, the Guest shall pay for the hardware, key copies and a $75.00 per hour labor fee. TCSFVR reserves the right to charge a lock out fee of up to $75.00 for after hour lockouts in addition to lost key charges.
  25. Property Availability: In the unlikely event that a homeowner would break their contract with TCSFVR, and an individual property would no longer be available, TCSFVR will offer comparable accommodations. Should the Guest not accept the comparable accommodations, TCSFVR is not obligated to any reduction and/or refund of the rental total. If a comparable accommodation is not available, TCSFVR will inform the Guest with as much notice as possible and provide a full refund.
  26. Personal Property: TCSFVR, property owners and broker are not responsible for the Guest’s personal property (including the personal property of those staying at the rental and any Guests of the Guest). TCSFVR, property owners and broker are not responsible for vehicles or any personal property left in vehicles.
  27. Alarm Systems: For those homes equipped with an alarm system, any fines associated with false alarms caused by the Tenant will be the responsibility of the Guest and charged to credit card or checking account information on file.
  28. Emergency Services: Guest will always be responsible for all charges/fees arising out of a call by the Guest or anyone in his/her party to emergency services or 911. This includes Police, Ambulance and Fire services.
  29. TCSFVR has a right to send marketing emails to the Guest using contact methods provided during the reservation process.
  30. TCSFVR is open from 9 AM to 5 PM Mountain Time. We are available for emergencies only outside of these hours.
  31. Guest shall be liable for reasonable attorney’s fees and expenses incurred by the Owner or TCSFVR (and their agents and employees) should Guest breach this agreement or in the event Guest does not prevail in any claim brought by Guest against Owner and /or TCSFVR. The law of the State of New Mexico shall govern any and all disputes between the parties to this Agreement. Venue for any legal action between the parties shall be Santa Fe County, New Mexico.
